About Julian Smith

Julian is joint Head of Chambers of New Park Court Chambers (Newcastle upon Tyne) and prior to that appointment was Head of Chambers of New Court Chambers, Newcastle upon Tyne from April 2010.

He was appointed Recorder of the Crown Court in 2008.

Julian has a high profile and busy practice specialising in crime.  He receives instruction from a considerable number of defence solicitors and is preferred counsel for any matter of complexity and sensitivity for a number of them. 

Julian has a considerable experience of defending the full range of criminal matters including those facing allegations of serious sexual offences and rape, fraud, serious violence, robbery and drugs. 

He was appointed to grade 4 as a prosecutor some years ago and is a specialist rape and serious sexual offences prosecutor.  Julian was appointed as a specialist youth prosecutor for the Crown Court in the 1990s.

Julian is recommended in Chambers and Partners 2014 as having an "excellent eye for detail," and is singled out as "an extremely eloquent and persuasive advocate." He is also recommended in the Legal 500, 2013-2014 for Crime.



Sexual Offences

Julian has been prosecuting and defending cases of serious sexual offending for in excess of 15 years.  He has been involved with offences of the utmost gravity throughout that time including offences of alleged systematic abuse in Children's homes, child abuse of all types, rape (including multiple victims and defendants) and all levels of sexual offending.  Often instructed in cases in which the witnesses are or defendant is, particularly vulnerable or sensitive, Julian has a breadth of experience that enables him to deal with highly emotional witnesses and accused effectively.

Homicide and serious violence 

Julian is regularly instructed in cases of murder, manslaughter and death by driving offences.  These have regularly included complex issues of causation as well as the more common evidential issues.  Julian has received instruction to prosecute murders alone. 

Julian receives instruction in cases of organised and gang violence.

He has considerable experience in cases of child cruelty and baby battering.

Fraud and Drugs

Julian regularly receives instruction in cases of large scale fraud and deception requiring that large quantities of material be mastered as well as comprehending business systems, practices and fraudulent mechanisms.

He is regularly instructed in large scale multi-handed drugs conspiracies and is familiar with issues surrounding such cases including covert evidence sources, authorities for surveillance and the complex telephone and computer analysis.

Julian is familiar with POCA.

Other Matters

As well as Crime, Julian is also instructed in regulatory matters and disciplinary hearings in particular.

Julian is a qualified advocacy trainer.

Recent Cases

R v. M – represented the former Chair of the Cleveland Police Authority for perverting the Course of Justice and a separate trial for Witness intimidation.

R v. J – For Crown legal submissions regarding parking as part of the process of driving.  Deceased driving a van at speed into a rising sun, shining off a wet road in heavy snow collision with rear of the stationary delivery truck, the driver of which was convicted of Death by careless driving.

R v. N – Defending – N acquitted murder – eastern European defendants and victims.

R v. O  - Defendant Operation Phoenix case of violent, repeated rape by D of stranger. 

R v. L – Defending man accused persistent sexual and physical abuse of son and daughter.  Members of insular religious community.  Significant issues regarding ‘confessions’ to church members, disclosure etc.

R v. Z – Successful prosecution of Asian Student for drugging and raping fellow student.

R v. G and T – junior for Crown in prosecution for murder and fraud – body never recovered and estate alleged to have been taken over and disposed of by two Defendants.
