Court of Protection

Court of Protection cases throw up a variety of issues relating to the protection of vulnerable adults. The members of New Park Court Chambers’ civil and family teams have the skill set to be able to deal with these cases, born from many years’ experience in the fields of personal injury, family, contentious probate and public law.

The basis of any Court of Protection case is an understanding of the relationship between the competing parties, of what each party hopes to gain and what the party lacking capacity wants and what, objectively, is in the best interest of the party lacking capacity. Few cases come to a hearing in the end but for those that do, Counsel with an appreciation of Court of Protection procedures, where there is a slightly less formal atmosphere than other tribunals, can be at an advantage in persuading the Court of the validity of his case.
