Environment

A cross-section of members of the specialist regulatory, criminal and civil teams at New Park Court Chambers have extensive experience and expertise in environmental law litigation. Members provide a comprehensive service in relation to a broad range of environmental issues at national and European levels. Work undertaken by the team includes cases involving:- Agriculture; agro-chemicals; animal welfare; chemicals haulage; environmental health; equine-related litigation; fisheries; fire regulations; food safety; forestry; health and safety – construction sites, factories, maritime, mining, railways; inquests; local authority sites for travellers; milk quota; nuisance; organo-phosphate/chemical poisoning; pesticides safety; planning appeals and inquiries; pollution; public inquiries; river pollution; trading standards; veterinary products; waste management. Members provide expert advice and representation for prosecuting authorities and for corporate and individual defendants and respondents in environmental casework in both criminal and civil courts. A number of practitioners have specialist experience in high profile and ground-breaking casework. Members of the team have taken cases on appeal or judicial review from Magistrates’ Courts to Crown Court, Administrative Court, Court of Appeal, Supreme Court and the European Court. Juniors and silks at New Park Court have, collectively, many years’ experience as counsel on the Attorney-General’s Panels, and are instructed in casework brought by Government Departments, (including the Department for the Environment, Food and Rural Affairs and the Health and Safety Executive,) and by Government Agencies, (including the Food Standards Agency and the Milk Marketing Board,) and by Non-Departmental Public Bodies, (including the Marine Management Organisation and the Environmental Agency).

Specialist experience in the team includes prominent prosecution and defence of corporate manslaughter cases, railway disasters and marine incidents involving multiple loss of life, and fisheries prosecutions that have attracted national media attention and have been debated in the House of Commons and the Northern Ireland Assembly. Additionally, members of the team are able to provide expert advice and representation in related proceeds of crime proceedings, and have been engaged at first instance and on appeal in casework involving substantial monetary claims, including Serious Organised Crime Agency confiscations. A number of New Park Court’s environmental law team accept Direct Public Access instructions, supply training at seminars and lectures, and are actively involved in the UK Environmental Law Association.
